The South Dakota legislature will consider two competing bills surrounding commercial surrogacy. The bill, HB 1311, would ban commercial surrogacy in the state and force biological parents to go through the adoption process. And SB 137 would codify commercial surrogacy and set regulations for the industry. Both sides agree that it is necessary for the first time in 30 years to pass some kind of law to start regulating the surrogacy industry by state legislation.
