Children’s Minister Roderic O’Gorman said a special legal agreement may be needed for children born through international commercial surrogacy. That due to the different legal situations of such children and depending on the way in which they were conceived, individual legal decisions may be required. Currently, children born through commercial surrogacy are in a precarious position. If, for example, their father has health problems, the children may be left without parents in the eyes of the state, since their mother only has the right to custody and only in those cases when she lives with the child’s father.
