The US has changed its policy on granting citizenship to children born through surrogacy or IVF

The State Department has revised its policy on granting citizenship to children born through surrogacy or in vitro fertilization. The State Department currently approves US citizenship for children born abroad to same-sex or heterosexual American parents through assisted reproductive techniques. Under the new policy, a child must be born abroad to married parents, and at least one parent must be a US citizen. A child must have a biological relationship with at least one parent. The rule that considered children born abroad to a surrogate mother to be born out of wedlock, even if the parents were married, has now been abolished. The new policy follows two federal cases on the issue and is a landmark moment for all the families who have spoken out against the State Department’s unconstitutional policy.
